Terms of Service

1. Definitions

SimplySport is a SaaS (Software as a Service) provided for managing Italian amateur sports associations (ASD/SSD). The term "Customer" means the individual or legal entity that subscribes to a paid plan or starts a free trial. The term "User" means any person who accesses the platform using credentials provided by the Customer.

2. Acceptance of Terms

By registering on SimplySport or using the service, the Customer declares to have read, understood and fully accepted these Terms of Service and the Privacy Policy. If the Customer does not accept these Terms, they may not use the service.

3. Service Description

SimplySport provides a web platform for managing members, subscriptions, lessons, attendance, payments, expenses and compliance obligations for Italian combat sports associations (ASD/SSD). The service includes:

• Multi-tenant management with per-gym data isolation
• Compliance tools for Italian ASD regulations (D.Lgs. 36/2021, L. 398/91)
• Generation of non-fiscal receipts compliant with L. 398/91
• Automatic reminders for expiries (medical certificates, cards, subscriptions)
• Installable Progressive Web App (PWA) for smartphones

4. Plans and Payments

SimplySport offers three paid plans (Starter, Pro, ASD+) with monthly or annual billing. Prices are listed on the Pricing page. The 14-day free trial requires no credit card. At the end of the trial period, the service automatically suspends unless a paid plan is subscribed.

Payments are processed via PayPal. SimplySport does not store credit card data. Invoices are issued in electronic format.

5. Customer Obligations

The Customer agrees to:

• Provide truthful information during registration
• Keep login credentials confidential
• Use the service in compliance with applicable law
• Not transfer access to unauthorized parties
• Be responsible for member data entered into the platform, acting as Data Controller under the GDPR

6. Data and Privacy

SimplySport acts as Data Processor for the personal data of members entered by the Customer, who remains the Data Controller. Processing is carried out as described in the Privacy Policy and in the Data Processing Agreement (DPA) available on request. Health data (medical certificates) is processed with additional security measures under Art. 9 GDPR.

7. Limitation of Liability

SimplySport provides software tools to support the management of ASD/SSD associations. It does not replace legal, tax or professional advice. Correct application of ASD regulations (D.Lgs. 36/2021, L. 398/91, GDPR) remains the sole responsibility of the Customer and the association's president. SimplySport is not liable for penalties or consequences resulting from incorrect use of the tools provided.

8. Suspension and Cancellation

The Customer may cancel their account at any time. In case of non-payment, the service is suspended 7 days after the due date. Data is retained for 30 days after cancellation, then permanently deleted. The Customer may request a data export before cancellation.

9. Changes to the Terms

SimplySport reserves the right to modify these Terms with 30 days' notice via email. Continued use of the service after notification constitutes acceptance of the changes.

10. Governing Law

These Terms are governed by Italian law. Any dispute is subject to the exclusive jurisdiction of the Court of Milan, unless otherwise agreed in writing between the parties.
